Welcome to the Peckham Art Studio ("AGP Creative Works", "we", "us" or "our") website, peckhamartstudio.com (the "Site"). By using or accessing the Site, either directly or indirectly, you agree to all of the following terms and conditions (collectively, the "Conditions"). If you do not agree with any of the Conditions, you must immediately cease all use of the Site and any services offered by us. We reserve the right to make changes to the Conditions at any time. When changes to the Conditions are made, they will be posted here. Check back here periodically to review changes to the Conditions. Your continued use of the Site signifies your agreement to the changes to the Conditions.

Errors, Inaccuracies and Omissions

This Site may possibly contain typographical errors, inaccuracies and/ or omissions in any of the information provided by us. This may include but is not limited to: the Conditions, the Privacy Policy, text or graphics displayed on any page on the Site and/ or product information. We reserve the right to modify and correct any of these errors, inaccuracies and/ or omissions at any time (including after time of purchase). We undertake no obligation to amend, update or clarify information contained on the Site, including without limitation, pricing information, except as required by law.

Data Protection, Security and Privacy

This Site uses the Squarespace platform and as such, all data is secured by the measures set in place by Squarespace. We greatly value your privacy as well as employ the use of cookies. Shipping

​

We offer shipping to most regions in Canada and the US which are within the reach of standard shipping. Shipping cost is factored into the final purchase price of your order. Service to the US may be suspended due to increased costs brought on by tariffs.

Once you place an order and your payment is received, your order will be placed in queue for production. After the print has been produced and inspected for quality, it will then be packaged and shipped to the location which you have designated. The queue and production phases may take up to two weeks to complete and shipping may take up to a month, depending on size of the print as well as external circumstances which we cannot control. If you have purchased more than one item, it is possible that the items may be shipped separately, and therefore may not necessarily arrive at your designated shipping location at the same time.

Payment

​

Payment must be made if full at the time of purchase. Orders will only be queued for production once the full payment has been received. Payments may only be made using credit card. All appropriate taxes and duties required by your country and/ or region will be charged at checkout.

Billing Information

​

We reserve the right to refuse or cancel any order placed with us at anytime, in our sole discretion. We may limit or cancel quantities purchased by order, by person or by shipping and/ or billing address. If in the event that we reduce the quantity of items in your purchase or cancel your purchase outright, we will attempt to contact you via any of the contact information which you have provided, including but not limited to email or phone number, and may issue a refund based on the changes to your purchase.

You agree that all account and billing information which you provide us is current, complete and accurate. You agree to promptly update any account and/ or billing information in the event that it changes, before you make any purchases with us.

Refund Policy

​

Peckham Art Studio does not offer refunds for services or products purchased via this Site or by other means. The only exemptions to this are if we are required by law or at the sole discretion of Peckham Art Studio. Complaints such as (but not limited to) size, colour, texture or surface reflection will not be considered in our decision to offer an exemption.

In the case that a printing error such as a scratched, chipped or cracked surface is discovered upon receipt of the product, the product may be eligible to be replaced by an identical product. In such a case, you may be provided with the shipping documentation required to ship the product back; which, only upon receipt of the damaged product will the replacement product be shipped to you. All requests for replacement shall only be accepted at the discretion of Peckham Art Studio. You may be asked to provide a picture of the damage so that we may determine if it is in fact damage or an intentional feature of the product or its design.

Cancelation of your order may be possible if the order has not yet entered production. We do not guarantee the acceptance any cancelation requests made in any specific timeframe. If you have determined that you wish to request a cancellation, you must contact us immediately at peckhamartstudio@gmail.com.

All content included in the Site, including but not limited to, text or graphics is copyrighted and protected by the Canadian Copyright Act as well as the United States (and other) copyright laws and intellectual property or proprietary rights.

Any and all use of our copyrighted material is strictly prohibited without the express permission of Peckham Art Studio. These prohibitions include but are not limited to, downloading the copyrighted material, the use of screen capture technology while any part of the copyrighted material is displayed on any screen, photography of any part of the copyrighted material whether on a screen or of a printed version of the copyrighted material.

Peckham Art Studio does not guarantee, represent or warrant that your use of the Site and/ or services will be uninterrupted, timely, secure or error-free, nor do we warrant that services obtained from the use of the Site are accurate or reliable.

You agree that we may cancel or remove the service for indefinite periods of time, at any time, without any notice to you.

You expressly agree that your use of, or inability to use the service and/ or any product provided by the service, is at your sole risk.

At no point will Peckham Art Studio, our directors, employees, affiliates, service providers or suppliers be liable for any claim, injury, loss, or any direct, indirect, punitive, incidental, special, or consequential damages of any kind, including, without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based on contract, tort, strict liability or otherwise, arising from your use of the service or any products procured using the service, or for any claim related in any way to your use of the service or any product procured using the service, including but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any product made available via the service. Our liability shall only be limited to the maximum extent permitted by law.

Dispute Clause

All disputes regarding any activity or content on the Site or any products procured using the services will be arbitrated in Ontario, Canada. In the case that you have in any way threatened or violated our intellectual property rights, Peckham Art Studio may seek an injunctive.
